Publications

A number of publications are produced by the University to provide information about events, policies, projects and other activities of interest to the Duke Community.  The Duke Dialogue, Inside DUMC and The Chronicle are free and are distributed at locations throughout the campus.

Duke Dialogues (681-4515) is a news publication for faculty, staff, and employees. This publication reports news specifically about Duke University in the areas of our mission (education, research, and patient care) and our community (people, events, and sports).  The Duke Dialogue is a valuable resource to help you stay current with employee events, compensation changes, and new programs.

eDuke is a new way of getting electronic news from Duke University and Medical Center.  It comes in three ways:

INSIDE is the employee newsletter for Duke University Medical Center and Health System (419-5054).  Published twice a month, the newsletter reports on Medical Center and Health System news including innovative programs, research advances administrative initiatives, upcoming events, and employment opportunities. http://inside.duke.edu/

The Chronicle (684-3811) is an independent, student‑operated newspaper.  This daily publication reports local and national news as well as University news.  Each fall the University publishes the Duke University Directory, which contains telephone and address listings for faculty, staff, and students.  It also contains other useful information and maps of the campus and hospitals.

Recruitment Office (Employment)

Recruitment and Talent Management recruits, screens and refers candidates for non-faculty job openings at Duke. Open positions are posted on the Duke Human Resources website at http://www.hr.duke.edu for a minimum of seven days.  Employees who are interested in applying for an open position submit their resume online via the Duke Resume Builder at http://www.hr.duke.edu. Staff members in the Human Resources Information Center (HRIC) are available from 8:00 am to 5:00 pm Monday through Friday for those who need assistance with the application process. Applicants may either visit the office located at 2024 West Main Street in the Red Mill Building or contact the call center at 684-5600.

Stores

The Duke University Stores, owned and operated by Duke University, provides a multitude of services to meet the needs of the University community.  The stores feature an extensive selection of merchandise, including school and office supplies, computers, software, office equipment, sundries, and Duke‑imprinted merchandise.  The stores are located on West, East, and North Campuses and the Medical Center.  The Gothic Bookshop and the Textbook Store in the Bryan Center and the Medical Center Stores in the Facilities Center (between Duke North and South Hospitals) are also available to staff.  The Terrace Shop is located at Sarah P. Duke Gardens

Temporary Services

Duke Temporary Services (DTS) provides qualified temporary employees to fill the staffing needs at Duke. This diversified pool of employees includes clerical, technical, service, research, clinical, and professional applicants. University Events

You and your family are invited to participate in the many social, cultural, and athletic events sponsored by the University during the year.  Art exhibits, visiting speakers, Duke Artist Series, Chamber Arts Society, Broadway at Duke, intercollegiate athletic contests, and numerous other activities are publicized in University publications. Some events are discounted for employees.

The information below is applicable to the benefits plans described in this brochure, except the universal life insurance coverage, as it is not covered under the Employee Retirement Income Security Act.

The plan administrator is responsible for the day-to-day operation and administration of the plan.  For example, the plan sets forth requirements for eligibility for plan participation, and the plan administrator makes sure these requirements are met.  The plan administrator is also the plan's agent for service of legal process.  The  name, business address and telephone number of the plan administrator and the employer, and the employer's identification number are:

Plan Documents

This brochure contains summaries of the plan documents governing the plans sponsored by Duke.  Each summary, together with other materials incorporated by reference into this brochure, is intended to serve as the ERISA summary plan description for the plan to which it pertains.  None of the summaries contain the complete text of its related plan.  The plan document for a plan is the detailed description of the plan's terms and conditions.  If there is a conflict between a plan document and its summary, the plan document will control.

To request copies of plan documents, call Benefits Administration.  A charge will be made for each copy you request.

Collective Bargaining Agreements

These plans are maintained pursuant to certain collective bargaining agreements. The agreements are available for your inspection in the Staff and Labor Relations department of Duke's Human Resources.

Family Leave Act Compliance

At all times these programs are administered in accordance with the provisions of the Family and Medical Leave Act of 1993.  The plan is construed and enforced according to North Carolina laws except to the extent these are superseded by the provisions of ERISA or other applicable federal laws.

Claims Procedure

In the event of your disability, dismemberment, or death, you or your beneficiary must make a written claim for the benefits and provide proof of the claim.

Claim Procedure for Insured Benefits

Several of the plans included in this brochure are insured.  A claim for benefits from an insured plan requires that a claim be made for benefits by filing a written claim and proof of death with the underwriter in accordance with the underwriter's guidelines.

Upon written request to the underwriter, you or your beneficiary will be provided with copies of any claim forms or instructions, or advised as to how to obtain the forms or instructions.  For your convenience, many claims forms are also available at your Benefits office.

The underwriter determines whether the claim is allowed.  If a claim is denied in whole or in part, the underwriter will notify the claimant and explain its procedure for reviewing a denied claim.  The underwriter will have sole responsibility for the review of and the final decision on any denied claim and is the named fiduciary for purposes of the review and final decision.

Claims Procedure for All Other Claims Related to the Plan

With respect to all claims or issues not subject to the above claims procedure, including the right of any claimant to participate under the plan, the below claims procedures apply.

You may make a claim by filing a written claim and proof of claim with the Plan Administrator in accordance with procedures and guidelines established from time to time by the Staff Fringe Benefits Committee (the "Committee").  The Plan Administrator will decide whether the claim will be allowed.

Eligibility determination and notification to you or your beneficiary will be made within 90 days after the proof of your loss is received.  In the event of special circumstances requiring an extension of time, written notice of extension will be provided to the claimant prior to the expiration of the initial 90-day period. In the event that the claim is wholly or partially denied, written notice will be provided and will also include an explanation of the specific reason for the denial, the provision of the plan on which the denial is based, any additional information necessary to perfect the claim and why that information is needed, and an explanation of the procedure for review of the denied claim.  If you wish to appeal the denial, the instructions in the section entitled "Appeal Review" should be followed.

Appeal Procedure

The claimant may appeal a denial of the claim within 60 days by filing a written application for review with the Staff Fringe Benefits Committee.  The Committee will fully and fairly review the decision within 60 days following receipt by the Committee of the request for review, or within 120 days if there are special circumstances requiring an extension of time.  The claimant will be provided with written notice on the Committee's decision.  The Committee's decision is final and conclusive.

If you are dissatisfied with the Committee's decision after you have pursued these steps, you have the right to file a lawsuit in a state or federal court.  You may not file a lawsuit before 90 days has passed after you file your claim or later than three years after the loss due to death, disability or dismemberment occurred.

Plan Modification and Termination

Duke reserves the right, in its sole discretion, to modify, suspend or terminate any plan at any time, for any reason.

Authority of the Committee and the Plan Administrator

Both the Staff Fringe Benefit Committee and the Plan Administrator have the duty and discretionary authority to interpret and construe the provisions of the plan, subject to the objective terms of the plan and the claims and claims review procedures described above.  Interpretations and determinations made by the Committee and the Plan Administrator will be applied uniformly to all persons similarly situated and will be binding and conclusive upon each eligible employee and dependent who is covered under the plan, his or her beneficiary and any other interested person.  Such interpretations and determinations made by the Committee and the Plan Administrator will only be overruled by a court of law if the Committee and the Plan Administrator are found to have acted arbitrarily and capriciously in interpreting and construing the provisions of the plan.

Your rights under ERISA (Employee Retirement Income Security Act)

Duke wants you to have all the benefits for which you are eligible.  This brochure describes the life insurance plans and tells you how to get more information.  The claims filing procedures tell you how to request benefits.  The appeals section tells you how to follow up on your request, if necessary.

ERISA requires that the following statement be included in summary plan descriptions for plans that are covered by this law.

Upon your request, the pertinent plan documents, insurance contracts, and all documents filed with the US Department of Labor, will be made available within 10 days for examination during normal working hours at Human Resources offices or Benefits Administration.  You may also obtain a personal copy of any of these documents, at a reasonable charge, by writing the appropriate plan administrator.  If copies of pertinent plan documents requested in writing are not furnished within 30 days, barring circumstances beyond the control of the plan administrator, you may file suit in a federal court seeking damages of up to $100 for each day of unexcused delay in providing such materials.

Once each year you will receive a summary of each plan's financial report, called a Summary Annual Report.  The plan's ERISA report is filed annually with the US government.

You have a right to expect "fiduciaries", the persons who are responsible for the administration of each plan, to act solely in the interest of participants and their beneficiaries and to exercise prudence in the performance of their duties.  If it should happen that the fiduciaries misuse a plan's money, you may seek assistance from the US Department of Labor, or you may file suit in a federal court.

No one may fire you or otherwise discriminate against you in any way to prevent you from obtaining a pension or welfare benefit under the plans, or exercising your rights under ERISA.  In other words, asserting a claim for a benefit or exercising your rights under ERISA will in no way affect your employment status.

Duke urges you to bring any questions or problems about your benefits to the attention of Benefits Administration.  This book summarizes the claims and appeal procedures for determining your benefits.  If a claim for a benefit is denied in whole or in part, the claimant, you or your beneficiary, will receive a written explanation of the reason for the denial.  The claimant has the tight to have the plan administrator review and reconsider the claim.  If the claimant is not satisfied with the results of the procedure, he or she may file suit in a federal or state court.

If you bring an action in any court relating to a plan, the court will decide who should pay court costs and legal fees.  If you are successful, the court may order the person you have sued to pay court costs and legal fees.  If you lose, the court may order you to pay these costs and fees if, for example, it finds the claim is frivolous.
